Operational Liability

Public Liability insurance usually already provides some form of cover for pollution liability.  However, this often causes a false sense of security as the cover is inadequate due to:

  • The cover being limited to “sudden and accidental” events – with no definition of what such an event is;
  • No cover for on site pollution and environmental damage;
  • No cover for events that do not impact third parties (and the Regulators or the Environment probably are not considered third parties); and
  • No cover for damage to Fauna and Flora – the key scope of liability under new legislation such as the EU Environmental Liability Directive.

The major impact of this is that any business relying on Public Liability insurance as form of Financial Provision for environmental damage remains significantly exposed.

Environmental Insurance programmes can be designed to manage these liabilities, providing more secure Financial Provision, without affecting the cover for other liabilities provided by the current Public Liability policy.
